RESERVATION

Terms and Conditions

General
When booking the rental of a property, Tropical Homes and Weddings Co., Ltd. acts as an agent on behalf of the owners or management of the property. All bookings are made subject to acceptance of the terms and conditions set below.

Bookings
Provisional Confirmation of Availability
Upon receipt of a request for availability, the applicable villa rates and the amount of deposit required will be confirmed.

Exclusions & Additional Charges
All villas that are equipped with telephone lines, all call charges will have to be settled before departure. Airport transport is provided for all villas either free of charge or at rates specified for each villa. Rates do not include baggage handling, gratuities, telephone, fax and telegram charges, car rental, food, soft drinks and/or liquor, personal items and expenses and any excessive cleaning required upon departure, (such as upholstery or rug shampooing, etc), or replacement of breakages. Fair wear and tear accepted.

Initial Deposit
An initial deposit of 30% of the villa rental is required to confirm a booking. No contractual obligation will exist prior to receipt of funds. If funds are not received within 5 banking days, the reservation shall be deemed to have been cancelled. For bookings of less than one week, or bookings made within 30 days of arrival, full payment is required at the time of reservation.

1Rates
Villa rental rates quoted by Tropical Homes and Weddings Co., Ltd . are on a per day/monthly basis and quoted in US dollars or THB Baht. Rates quoted allow for maximum occupancy of the villa as shown on the web site. Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes.

Balance Payment
Payment of the outstanding balance must be received at least 30 days prior to the arrival date. Should Tropical Homes and Weddings Co., Ltd. not receive the balance by the due date, we reserve the right to cancel the booking and cancellation charges will apply.

Cancellation
You may cancel your reservation at any time by notifying us in writing by email. The following cancellation terms apply:

More than 30 days prior to arrival - forfeiture of the deposit.
Less than 30 days prior to arrival - total cost.
If it becomes necessary to cancel all or any part of the booking, you must notify us by email.
The cancellation will take effect from the day the written confirmation is received.
In the event that the booking is cancelled prior to arrival we regret that no deposit can be refunded. However the deposit/full balance will be held over for a period or 12 months and credited to another booking by the same guests or another party of their choosing.
Once the final balance is received 30 days prior to arrival, the same cancellation conditions as above will apply. If the period of stay has to be shortened the full rental rates will still apply due to the popular nature of these houses.
2Amendment to Booking
A 1,000 Thai Baht administration fee will be charged by Tropical Homes and Weddings Co., Ltd. for any change to the booking after a confirmation has been issued. Acceptance of any change is subject to approval by the villa's owner.

Alteration or Cancellation by Tropical Homes and Weddings Co., Ltd.
In the unlikely event that Tropical Homes and Weddings Co., Ltd. or the villas owners/management has to make any changes to confirmed bookings, we will advise you at the earliest possible date. If a property is damaged or rendered unusable or if for any reason beyond our control or due to unexpected circumstances we are unable to provide you with the villa booked, Tropical Homes and Weddings Co., Ltd. or the villa owners/management shall reserve the right to cancel the reservation. However, Tropical Homes and Weddings Co., Ltd. or the villas owners/management will endeavour to locate an alternative property for the required period. If this is not possible or you do not wish to be transferred, the villa owners/management or Tropical Homes & Weddings will cancel the booking and refund you in full, less any bank transfer charges. Tropical Homes and Weddings Co., Ltd. shall not be liable for any further obligations or claims by the client.

Arrival & Departure Times
Guests should note the check-in time is after 2 pm., and check-out time is prior to 12 noon, unless otherwise specified or agreed. Account will be taken where possible of flight arrival/ departure times.

Registered Guests
Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The number of people staying at the property must not exceed the maximum capacity specified, except in the case of infants (under two years old), or unless specifically authorized. Should the owner/management of the villas or a Tropical Homes and Weddings Co., Ltd. representative find that the number of people staying at the property exceeds that on the booking form, additional guests will be subject to a per person, per day surcharge and/or may be asked to vacate the premises.

No camping is permitted in the property grounds and Tropical Homes and Weddings Co., Ltd. regrets that no pets are allowed. In line with their Corporate Responsibility, the management of some villas reserves the sole and exclusive right to request any guest to vacate a property in the event of any of the following cases:
a) male or female joiners are invited over to the property, as non-registered guests
b) any illegal activities with under-age individuals are witnessed (guests would be summoned to the local police)
c) any other illegal or immoral activities are done within the private boundaries of the property (eg: use of illegal drugs, illicit pictures and movies) No refund would be applicable.

Security Deposit
A security deposit may be payable to the villas owners/management with the payment of the balance. This is to cover the cost of any damage or breakages during the rental period of the Villa or their contents. It may also be used to cover the cost of telephone calls and other services. This amount will be returned to you at the time of departure, less any such costs.

Insurance
It is a condition of the booking that the entire party is covered by comprehensive travel insurance of their own (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including local treatment, evacuation and repatriation coverage). As deposits and rental payments may not be refundable after a reservation has been confirmed, you should consider an option of this travel insurance to cover the loss of money paid to the villa in case you might have to unexpectedly cancel your journey. Tropical Homes and Weddings Co., Ltd. and the villas owners/management are not responsible and are held harmless by you and your party against any and all claims including any accidents related to the use of the villa facilities or locally procured third party services such as but not limited to, watercraft, water sports, car or motorbike rental. Tropical Homes and Weddings Co., Ltd. and the villas owners/management shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside Tropical Homes and Weddings Co., Ltd� s control, such as civil disturbances, fires, floods, severe weather, acts of God, Acts of Government etc. By acceptance of this contract it is assumed by Tropical Homes and Weddings Co., Ltd. and the villas owners/management that this requirement will be complied with in full.

Liability Release
Under no circumstances shall Tropical Homes and Weddings Co., Ltd. and the villas owners/management be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodation as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodation herein or as substituted. If any accommodation and/or services are substituted, Tropical Homes and Weddings Co., Ltd. and the villas owners/management will act at all times in good faith and use its best efforts to substitute with accommodations and/or services of a type comparable to or better than those originally contracted. Tropical Homes and Weddings Co., Ltd., at its sole and unfettered discretion, reserves the right to refuse or discontinue service to any person (s) and/or to rescind any contract for accommodations or guest services.

Complaints
All properties descriptions provided by Tropical Homes and Weddings Co., Ltd. on the website and elsewhere are made in good faith.
Tropical Homes and Weddings Co., Ltd. accepts no responsibility for the following:

Any modifications made by the villas owners/management which are not mentioned on the web page or anywhere else
The breakdown of the supply of water, electricity or swimming pool filtration systems. However, shall you contact us during such problems we will use our best endeavour to arrange for any such problems to be solved quickly.
Any complaints must be notified to . Tropical Homes and Weddings Co., Ltd within 24 hours of the occurrence giving rise to the complaint.
Should a problem remain unsolved please make a complaint in writing to Tropical Homes and Weddings Co., Ltd or the villa owners/management within 14 days of the completion of the rental period.
If the villa is vacated before the end of the rental period without mutual agreement, this may result in the loss of all rights to compensation.
No claim can be made after the villa has been vacated if notification at the time of the problem occurrence was not made to Tropical Homes and Weddings Co., Ltd. and/or the villa owners/management.
Staff at the Villas
Some of the villas may include the service of one or several staff. Additional services such as those of cooks and/or drivers can usually be sourced. Please give ample notice, as soon as possible especially at peak holiday seasons and we shall try to assist. Tropical Homes and Weddings Co., Ltd . assumes no liability for such contracted staff. The rates for these services will be provided in advance and shall be paid by the guests as incurred.

Conduct & Behaviour
The person making the reservation is held responsible for the correct and appropriate behaviour of the guests staying at the villa. Should any member of the party not behave in such a manner, the villa owner/management or Tropical Homes and Weddings Co., Ltd. representative may at their absolute discretion ask the offending guest(s) to vacate the villa forthwith. Firearms, deadly weapons, pyrotechnics, prohibited drugs, and gambling are not permitted.

Linen & Towels
Linen and towels are included in all villas unless specified before deposit payment received by the owners/management. These are normally changed every 3 days. If you require more frequent changes there may be extra charges. Limited laundry facilities exist on site, with charges made per item. Outside services are also available for a small service charge and must be paid at the time incurred.

Valuables
All villas are either equipped with a safe in one of the rooms or a safe is available at the villa owners /management office. Any valuables left at the property are at the guests' own risk. Neither Tropical Homes and Weddings Co., Ltd. nor the villa owners/management nor the villas staff, are to be held responsible for their loss or damage.

Due Care of the Facilities
As part of this agreement and as all villas are privately owned, guests are required to take due care when residing at the villas, especially of children playing in the gardens, near or in the entrance, the road, the plunge pool/swimming pool, and the beach and/or sea. Furthermore, guests are reminded not to enter the villas wet as the floors can be slippery. Damage or injury arising shall not be the responsibility of Tropical Homes and Weddings Co., Ltd. in any way whatsoever. Handling of furniture, crockery and other artifacts shall be done with maximum care. The villa�s staff is there to help if necessary.

Applicable Law
These conditions and any contract to which they apply are governed in all respects by the applicable Thai law and the Thai courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
